Article 3 and Article 12: Complementary and Contradictory Aspects

Children’s participation in public decision making is central to the CRC. The two most relevant Articles in relation to participation are Articles 3 and 12 and it is important to discuss these two articles in detail along with their implications. Articles 3 and 12 are fundamental to all the other Articles in the CRC. They are, to use Davey and Lundy’s (2011) analogy, the wheel to which all the spokes are connected. Freeman (2007: 1) argues that ‘recognition of the child’s best interests underpins all the other provisions in the Convention’. Before discussing the nature of Article 3, it is useful to set out the text. In many publications, Article 3.1 is outlined while Articles 3.2 and 3.3 are rarely mentioned, but it is important to consider Article 3 in full:
